r~ O.x LU~ -1 ~o ii:~ ~u 6 ~j ORDINANCE2001-~ co ~.. ~ 08 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 8.39 ACRE TRACT OF PROPERTY LOCATED IN THE 2900 BLOCK OF IH-35 SOUTH FROM "I" INDUSTRIAL DISTRICT TO "C" COMMERCIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. 53. RECITALS: 1. On January 23, 2001, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "I" Industrial District to "C" Commercial District for a 8.39 acre tract of property located in the 2900 Block oflH 35 South. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on January 23,2001 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the 26th day of February 2001, regarding the request. 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned "I" Industrial District to "C" Commercial District: Street address: 2900 Block oflH 35 South. Size: 8.39 acres. Legal description: 8.39 acres, more or less, of land area in the J.M. Veramendi Survey No.1, City of San Marcos, Hays County, Texas. Being a portion of that tract described as 121.52 acres in a deed from JASBA GMBH to Capital Foresight Limited Partnership dated August 7, 1997, a metes and bounds description of which is attached as Exhibit A.
