54. DESCRIPTION OF 8.39 ACRES, MORE OR LESS, OF LAND AP.EA IN THE J.M. VERAMENDI SURVEY NO.1, CITY OF SAN ~_RCOS, HAYS COUNTY, TEXAS. BEING A PORTION OF THAT TRAC~ DESCRIBED AS 121.52 ACRES IN A DEED FROM JASBA GMBH TO CAPITAL ~ORESIGHT LIMITED PARTNERSHIP DATED AUGUST 7, 1997 AND RECORDED IN VOLUME 1336, PAGE 595 OF THE HAYS COUNTY OFFICIAL PUBLIC RECORDS AND BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS: BEGINNING at a ~" iron rod found in the northwest line of that tract described as 1.616 acres in a deed from Norman Jackson to the State of Texas dated AprilS, 1957 and recorded in Volume 170, Page 482 of the Hays County Deed Records, and being a northwest line of Interstate Highway No. 35 for the south corner of the Capital Foresight 121.52 acre tract and the east corner of that tract described as 9.438 acres in a deed from Joe Bob Millican et al to K.B.L.B., Inc. dated November 1, 1996 and recorded in Volume 1266, Page 132 of the Hays County Official Public Records; THENCE leaving the PLACE OF BEGINNING, the State of Texas tract and Interstate Highway No. 35, with the common southwest line of the Capital Foresight tract, as shown on that plat numbered 24426-00-4- c dated December 18, 2000 as prepared for Nary Said off by Byrn & Associates, Inc. of San Marcos, Texas, N 450 24' 26" W 730.67 feet' to a ~" iron rod found for the east corner of a 0.75 acre access easement granted in a deed from KBLB Partners to Capital Foresight, dated September 10, 1998 and recorded in Volume 1473, Page 700 of the Hays County Official Public Records; THENCE leaving the KBLB Partners tract and the Capital Foresight access easement tract and crossing a portion of the Capital Foresight Limited Partnership 121.52 acre tract, the following two courses: 1. N 440 08' 00" E 500.00 feet to a ~" iron rod set, and- 2. S 450 24' 26" E 730.67 feet to a W' iron rod set in the "'" common southeast line of the Capital Foresight 121.52 acre tract and the northwest line of the State of Texas tract and the northwest right-of-way line of Interstate Highway No. 35; THENCE with the_ common southeast line of the Capital Foresight Limited Partnership 121.52 acre tract, the northwest line of the State of Texas 1.616 acre tract and the northwest right-of-way line of Interstate Highway No. 35, S 440 08' 00" W (this being the"'- Bearing Basis for this description) 500.00 feet to the PLACE OF BEGINNING. There are contained within these metes and bounds 8.39 acres, more or less, of land area as prepared from public records and a survey made on the ground on December 18, 2000 by Byrn & Associates, Inc. of San Marcos, Texas.
