<br />56. <br /> <br />RESOLUTION NO. 2001 - <br /> <br />33 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS APPROVING THE TER.\1S AND <br />CONDITIONS OF AMENDMENT NUMBER FIVE TO THE <br />LEASE OF AIRPORT PROPERTY BETWEEN McKEE <br />AVIATION AND AVIONICS, INe. AND THE CITY; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />AMENDMENT; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. On July 29, 1986 the City entered into an agreement (the "Lease") with John 1. Stokes, Sr. <br />for the construction of a hangar. This agreement was amended on July 26, 1988 by Stokes and the <br />City, and ultimately assigned to McKee Aviation, Inc. on January 17, 1990. The original agreement <br />has subsequently been amended on February 13, 1990, October 14, 1997, and June 23, 1998. <br /> <br />2. The Lessee wishes to amend the Lease to permit the Lessee to mortgage the Lessee's <br />leasehold interest in order to secure funding to payoff liens associated with the Lessee's original <br />acquisition of the leasehold from John J. Stokes, Sr. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. <br /> <br />The attached Amendment Number Five to the Lease is approved. <br /> <br />PART 2. <br /> <br />The City Manager, Larry D. Gilley, is authorized to execute the amendment. <br /> <br />PART 3. <br /> <br />This Resolution shall be in full force and effect from and after its passage. <br /> <br />ADOPTED on February 26, 2001. <br /> <br />12(J6J~ ~' <br /> <br />.
