75. RESOLUTION NO. 2001- 38 R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE ISSUANCE OF A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY TO MAMMOTH AUTOS, LLC, DBA TEXAS TAXI AND SHUTTLE, FOR THE PROVISION OF TAXICAB SERVICES IN SAN MARCOS, AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. On March 5, 2001 , the San Marcos City Council held a public hearing regarding an application for a Certificate of Public Convenience and Necessity from Mammoth Autos, LLC, d/b/a! Texas Taxi and Shuttle, for the provision of taxicab services in the City. 2. Subsequent to the public hearing on that date, the City Council determined that all requirements of Chapter 90, Article 3 of the San Marcos City Code pertaining to the issuance ofa taxicab business certificate of convenience and necessity have been met by the applicant. 3. The City Council finds that this taxicab business is required to adequately serve the public convenience and necessity and that the applicant is fit, willing and able to operate a taxi business and to conform to the provisions of City ordinances. BEITRESOL VED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The issuance of a Taxicab Business Certificate of Public Convenience and Necessity to Mammoth Autos, LLC, d/b/a! Texas Taxi and Shuttle, is hereby approved. PART 2. The City Secretary, Janis K. Womack, is directed to issue a Taxicab Business Certificate of Public Convenience and Necessity to Mammoth Autos, LLC, d/b/a! Texas Taxi and Shuttle, upon the City Attorney's review and approval of proof of liability insurance coverage for the company. PART 3.
