City Code Section 62.027 provides for the Police Department to make fingerprinting <br />services available to the public for identification purposes from 8:00 a.m. to 5:00 p.m., Monday <br />through Friday. <br /> <br />2. The City Council wishes to change this ordinance to allow the Police Department <br />flexibility in setting the times and days that it will provide fingerprinting services to the public. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. Section 62.027 of the City Code is amended as follows (underlining: indicates <br />added text; OvcI5tlike indicates deleted text): <br /> <br />Sec. 62.027. Fingerprinting for identification. <br /> <br />(a) The police department shall charge a fee for fingerprinting services described in this <br />division in an amount established by the city council. Fingerprinting of children under the age of <br />17 at the request of their parent or legal guardian is exempt from this fee. <br /> <br />(b) Public fingerprinting services shall be available at the San Marcos Police Department at <br />dates and times set by the chiefofpoliceolll)i bct\'\>ccn thG hot11~ 0[8.00 tun. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br /> <br />SECTION 4. Any person violating any provision of this ordinance commits a misdemeanor <br />and is subject to the penalty provided in Section 1.015 ofthe San Marcos City Code upon conviction. <br /> <br />SECTION 5. This Ordinance will take effect 10 days after the date of its final passage, and <br />the City Secretary will publish notice of its adoption in a newspaper of general circulation in the <br />City. <br />
