MARCOS, TEXAS, READOPTING CHAPTER 18, ARTICLE 6 OF THE CITY <br />C\\ ~ CODE ENTITLED SEXUALL Y ORIENTED BUSINESSES WITH <br />- ~:IE AMENDMENTS AFTER PUBLIC HEARING AND REVIEW OF STUDIES; <br />~ ::d Jj INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />~ ~;PENALTIES. <br />(,,)(3 <br />RECITALS: <br /> <br />1. The City Council wishes to amend the City's regulations regarding sexually oriented <br />businesses, Article 6 of Chapter 18, Businesses, of the City Code, to ensure their enforceability. <br /> <br />2. The City Council has received and reviewed information from City staff, including complete <br />land use studies and summaries of land use studies that discuss the adverse secondary effects of <br />sexually oriented businesses, such as increases in crime and decreases in property values. The <br />Council expressly makes all of the findings contained in the revised version of subsection (a) of <br />City Code Section 18.242 attached. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. Chapter 18, Article 6 of the City Code, entitled Sexually Oriented <br />Businesses, with amendments, is readopted with amendments as follows (underlining indicates <br />added language; on overstrike indicates deleted language): <br /> <br />ARTICLE 6. SEXUALLY ORIENTED BUSINESSES* <br /> <br />DIVISION 1. GENERALLY <br /> <br />Sec. 18.241. Definitions. <br /> <br />In this article: <br /> <br />Adult arcade means a business which offers its customers, in one or more enclosures <br />designed for occupancy by up to 5 persons, still or motion pictures characterized by <br />depiction of sexual nudity or sexual activities. <br /> <br />Adult bookstore or adult video store means a business in which a substantial portion of <br />the stock in trade consists of books, videos, tapes, cassettes, photographs, slides, <br /> <br />1 <br />
