<br />Sec. 18.243. Enforcement. <br /> <br />(a) A person who violates any provision of this ordinance regarding a sexually <br />oriented business meeting the primary business test in section 18.241 is subject to <br />prosecution under V.T.C.A., Local Gov't Code, Chapter 243. <br /> <br />(b) It is a defense to prosecution under subsection 18.250(d) or section 18.251 that a <br />person appearing in a state of nudity did so in a modeling class operated: <br /> <br />(1) By proprietary school licensed by the state; a college, junior college or university <br />supported entirely or partly by taxation; <br /> <br />(2) By a private college or university that maintains and operates educational <br />programs in which credits are transferable to a college, junior college or university <br />supported entirely or partly by taxation; or <br /> <br />(3) In a structure: <br /> <br />a. That has no sign visible from the exterior of the structure and no other advertising <br />that indicates a nude person is available for viewing; <br /> <br />b. Where, in order to participate in a class, a student must emoll at least three days in <br />advance of the class; and <br /> <br />c. Where no more than one nude model is on the premises at anyone time. <br /> <br />Sec. 18.244. Injunction. <br /> <br />A person who operates or causes to be operated a sexually oriented business without a <br />valid license or in violation of section 18.246 is subject to a suit for injunction and/or for <br />administrative penalties in addition to prosecution for criminal violations. <br /> <br />Sec. 18.245. Reserved. <br /> <br />Sec. 18.246. Location. <br /> <br />(a) It is unlawful for a person to operate or cause to be operated a sexually oriented <br />business within the central business area zoning district or within, 1,000 feet of: <br /> <br />(1) A church; <br /> <br />(2) A public or private elementary or secondary school; <br /> <br />5 <br />
