The City currently awards contracts for which competitive bidding is required <br />on the basis of the lowest responsible bidder. <br /> <br />2. Lac. Gov. CODE S271.905 authorizes the City Council to grant preferences to <br />local bidders, if their bids are within three percent of bid submitted by the lowest <br />responsible bidder, if the City Council makes certain findings. <br /> <br />3. The City Council wishes to amend the City Code to provide for a preference to <br />be given to local bidders in appropriate circumstances. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. Chapter 2, Administration, of the City Code is amended by adding a <br />new Section 2.569 to read as follows: <br /> <br />Sec. 2.569. Local bidder preference. <br /> <br />(a) In this section: <br /> <br />Local bidder means a bidder whose principal place of business is located within the <br />city. <br /> <br />Nonresident bidder means a bidder whose principal place of business is not located <br />within the city. <br /> <br />(b) In purchasing any real property or personal property that is not affixed to real <br />property, if the city receives one or more bids from local bidders, and the bids are <br />within three percent of the lowest responsible bid received by the city from a <br />nonresident bidder, the city council may award the contract to the lowest <br />responsible bidder who is a local bidder, if the city council determines in writing <br />that the local bidder offers the city the best combination of contract price and <br />additional economic development opportunities for the city created by the contract <br />
