INTERLOCAL COOPERATION AGREEMENT <br />BETWEEN TEXAS STATE UNIVERSITY -SAN MARCOS AND <br />THE CITY OF SAN MARCOS <br />FOR THE PROVISION OF WATER QUALITY ANALYTICAL TESTING SERVICES <br />STATE OF TEXAS <br />COUNTY OF HAYS <br />The City of San Marcos ( "City ") and Texas State University -San Marcos ( "TXSTATE ") <br />collectively referred to as the "Parties" enter into this Interlocal Agreement (the "Agreement ") <br />under the authority of the Interlocal Cooperation Act (the "Act "), Chapter 791 of the Texas <br />Government Code, as amended. <br />RECITALS: <br />WHEREAS, the City wishes to procure water quality analytical testing services from <br />TXSTATE; and <br />WHEREAS, it is in the interest of economy and efficiency, that the parties enter into a <br />cooperative program; and <br />NOW THEREFORE, in consideration of the mutual covenants and promises contained <br />herein, the parties agree as follows: <br />Section 1. Scope of Services <br />TXSTATE agrees to provide microbiological, liquid and solid analytical services (the <br />"Services ") in accordance with applicable State and Federal laws, rules, regulations and orders as <br />applicable and the cost proposal attached to this Agreement as Attachment A. <br />Section 2. City Responsibilities <br />The City agrees to provide accurate information and render decisions as expeditiously as <br />possible for the orderly progress of TXSTATE's services. <br />Section 3. Compensation <br />A. Basic Services: The City agrees to pay TXSTATE a not to exceed total fee of <br />
