• ORDINANCE 2011 - <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, REPEALING CERTAIN ORDINANCES GRANTING <br />THE CONSENT OF THE CITY OF SAN MARCOS TO THE CREATION OF: <br />(1) SAN MARCOS MUNICIPAL UTILITY DISTRICT NOS. 1 AND 2; (2) <br />LOWMAN RANCH MUNICIPAL UTILITY DISTRICT; HAYS COUNTY <br />MUNICIPAL UTILITY DISTRICT NOS. 2 AND 3; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. <br />RECITALS: <br />1. WHEREAS, the City consented to the creation of five municipal utility districts in <br />the City's extraterritorial jurisdiction from 1985 - 1987; and <br />2. WHEREAS, the San Marcos Municipal Utility Districts Nos. 1 and 2 and the <br />Lowman Ranch Municipal Utility District was never filed at the Texas Commission on <br />Environmental Quality ( "TCEQ ") and therefore were never established and do not exist; and <br />3. WHEREAS, the Hays Count Municipal Utility Districts Nos. 1 and 2 were <br />created at the Commission but were subsequently dissolved; <br />4. WHEREAS, the TCEQ has verified the facts in recitations 1 — 3 above; <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The following ordinances are hereby repealed in their entirety: <br />1. Ordinance No. 1985 -118 which established San Marcos Municipal Utility District No. 1 <br />as amended by Ordinance No. 1987 -118. <br />2. Ordinance No. 1985 -117 which established San Marcos Municipal Utility District No. 2 <br />as amended by Ordinance No. 1987 -150. <br />3. Ordinance No. 1987 -20 which established Lowman Ranch Municipal Utility District as <br />amended by Ordinances Nos. 1988 -51, 1988 -80, and 1988 -81. <br />4. Ordinance No. 1985 -119 which established Hays County Municipal Utility District No. 2 <br />as amended by Ordinance No. 1987 -11R. <br />5. Ordinance No. 1985 -120 which established Hays County Municipal Utility District No. 3 <br />as amended by Ordinance No. 1987 -12. <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to <br />be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />• ordinance will continue in force if they can be given effect without the invalid portion. <br />1 <br />
