<br />MUTUAL RELEASE
<br />
<br />F or purposes of this agreement, the terms used herein are defmed as follows:
<br />
<br />a. "Lov..1:laO" means LOWMAN RANCH, LTD., a Texas Limited Partnership, its
<br />successors, assigns, predecessors and successors in interest, and its present and
<br />former agents, servants, employees, representatives, and attorneys.
<br />
<br />b. "Tanger" means STM~EY K. TANGER and TA.~GER PROPERTIES LIMITED
<br />PARTNERSHIP, a North Carolina Limited Partnership, their heirs, beneficiaries,
<br />assignees, predecessors or successors in interest, present and former agents, officers,
<br />directors, partners, servants, employees, representatives, attorneys, parent entities,
<br />subsidiaries, affiliates, and/or legal representatives, in their individual or
<br />representative capacities.
<br />
<br />c. "City" means the CITY OF SAN MARCOS, a Texas Municipal Corporation, its
<br />successors, assigns, predecessors and successors in interest, and its present and
<br />former agents, servants, employees, representatives, and attorneys.
<br />
<br />d. "Lawsuit" means that certain lawsuit styled Lo'Wman Ranch. Ltd. vs. Stanley K.
<br />Tanger and Tanl?:er Properties Limited Partnership. Cause No. 2000-0719 in the 20~
<br />District Court of Hays County, Texas.
<br />
<br />All other terms in this agreement shall be given their plain and ordinary meaning, unless otherv.ise
<br />
<br />stated herein.
<br />
<br />NOW, KNOW ALL MEN BY THESE PRESENTS, that FORAND IN CONSIDERATION
<br />
<br />of the payment of the mutual covenants contained in a Mediation Agreement dated
<br />
<br />,2001, between Lowman, Tanger, and the City, and in exchange for other
<br />
<br />valuable consideration described herein, the receipt and sufficiency of \Vhich is hereby acknowledged
<br />
<br />by the parties, the parties hereby fully and forever mutually release and discharge each other from
<br />
<br />and waive any and all claims, rights, demands, damages, losses, payments, obligations, liabilities,
<br />
<br />costs, claims for indemnity, contribution or attorney's fees, causes of action and lawsuits of any and
<br />
