<br />vacant position, upon being qualified under subsection (g). If both alternate members are <br />eligible, they will draw lots to determine who will fill the vacancy. An alternate member <br />does not have authority as a regular member, does not have a vote on the commission, <br />and does not have a right to participate in commission discussions except as a member of <br />the public. Alternate members may participatc, however, in commission workshops. <br /> <br />(f) The council shall appoint eligible persons to fill vacancies in positions of alternate <br />members. Persons appointed to these vacancies serve the remainder of the term of the <br />alternate member they replace. If a vacancy occurs in a position of a regular member at a <br />time when no alternate member is currently eligible to assume the position, the council <br />shall make an appointment of an eligible person to directly fill the vacancy, subject to <br />qualification under the training requirements in subsection (g). <br /> <br />(g) A newly appointed regular member, to be qualified to take office, and a newly <br />appointed alternate member, to be qualified to fill a vacant position as a regular member, <br />must have attended an orientation meeting with the director of planning and development <br />services, and must have attended a seminar on land use, environmental and planning <br />issues approved by the director. Attendance at required training before a person is <br />appointed as a regular or alternate member must have occurred within three years prior to <br />the appointment for the training to satisfy these requirements. The director will advise <br />newly appointed members who do not already meet these requirements of the date and <br />location of approved seminars, and will facilitate their registration and attendance at the <br />seminars. frfl€i The members are entitled to reimbursement for reasonable costs of <br />attendance. If a newly appointed regular or alternate member does not already meet these <br />attendance requirements at the time of appointment, and the member fails to fulfill these <br />attendance requirements within six three months of being appointed, the appointment is <br />automatically rescinded and the city council will make a new appointment. <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be <br />unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in conflict with <br />this ordinance are repealed. <br /> <br />SECTION 4. Any person violating any provision of this ordinance commits a misdemeanor <br />and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon <br />conviction. <br /> <br />SECTION 5.
