The City staff has proposed the institution of a "Read and Leave" program under <br />which owners or managers of rental property can accept responsibility for payment of electric <br />services during periods of time between tenants, in exchange for a waiver of the short-term <br />service fee that would otherwise apply. <br /> <br />2. The San Marcos Electric Utility Board has reviewed the proposed program, and <br />recommends that it be adopted by the City Council <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. Rate Schedule MSC, Miscellaneous Service Charges, of the Electric Utility <br />Department rate schedules established under City Code Section 86.167 is amended by revising <br />the text of the paragraph on "Short-Term Service Charge" as follows (underlining indicates <br />added text; oyerstrike indicates deleted text): <br /> <br />SHORT - TERM SERVICE CHARGE <br />This charge shall be made when services is disconnected at the request of the customer <br />within thirty (30) days or less from the date service is first made available by the City. <br />This charge shall be waived if a property owner or manager 1) has a current "Read and <br />Leave" program agreement on file with the Electric Utility Department. and 2) complies <br />with all current requirements of the Electric Utility Department for participating in the <br />"Read and Leave" program. <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br /> <br />SECTION 4. Any person violating any prOVISIOn of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City <br />Code upon conviction. <br /> <br />C:\TEMP\electric tariff amdmt.doc <br />
