<br />)ffice of the City Manager <br /> <br /> <br />_Z,?,.2..:..- <br /> <br />May 22, 2001 <br /> <br />Dr. Jerome Supple, President <br />Southwest Texas State University <br />601 University Drive <br />San Marcos, TX 78666 <br /> <br />Re: Memorandum of Understanding <br />Cost-Sharing - Habitat Conservation Planner <br /> <br />Dear Dr. Supple: <br /> <br />For several years, the City and SWT have been sharing the costs for a habitat conservation planning <br />effort related to the San Marcos River. The shared costs relate to one full-time employee of the City <br />(the "Planner") who coordinates the planning effort. At the present time, the City's job title for the <br />Planner is Watershed Protection Manager. You may be aware that the City has recently created and <br />filled three other full-time positions connected with the habitat conservation planning effort and <br />other related programs of the City. <br /> <br />The intent of this memorandum is to formalize the agreement we have had to share the cost of the <br />Planner. The City agrees to employ the Planner on a full-time basis. The City agrees to provide the <br />Planner with office space, and to make the Planner available to SWT at reasonable times for <br />consultation regarding matters involving the San Marcos River and associated watersheds. The City <br />will supervise the Planner, and the City may change the responsibilities, reporting structure, job title <br />or classification, and rate of pay and benefits for the Planner at any time and without any advance <br />approval by SWT. The City will have sole discretion in the hiring and termination of persons for <br />the Planner position. <br /> <br />SWT agrees to pay one-half of the salary and benefits for the Planner. SWT will make payments <br />to the City on an annual basis upon submission of invoices by the City. SWT acknowledges that <br />because the Planner will be a full-time City employee, SWT will not have day-to-day or task~specific <br />access to or oversight over the Planner. The City will cooperate with SWT, however, so that the <br />Planner provides an active and constructive role in assisting SWT in achieving its conservation <br />objectives.
