<br />260. <br /> <br />RESOLUTION NO. 2001- 90 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF <br />A LICENSE AGREEMENT FOR A TT ACHMENTS TO UTILITY <br />FACILITIES BETWEEN THE CITY AND FIBER AMERICA NO.1, L.P.; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />AGREEMENT ON BEHALF OF THE CITY AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. Fiber America No.1, L.P. is proposing to construct communication lines in the City to provide high- <br />speed data transfer services to individual customers with whom it negotiates agreements. The firm has <br />registered with the City as a certificated telecommunications provider ("CTP") under the provisions of Local <br />Government Code Chapter 283. <br /> <br />2. Fiber America is proposing to use existing Electric Utility Department poles for mounting its wires. <br />The attached agreement would provide for this use. The attached agreement is based on a model agreement <br />drafted for the Texas Public Power Association, and is similar to the one the City executed last year with <br />Grande Communications. <br /> <br />3. Under the agreement, permits from the City will be required for all new installations and facility <br />changes made by Fiber America, Fiber America will bear the cost of any modifications to City poles that are <br />needed to allow Fiber America to install its lines, and Fiber America will pay the City at the current rate of <br />$4.00 per pole attachment per year. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The attached License Agreement for Attachments to Utility Facilities between the City of <br />San Marcos and Fiber America No.1, L.P. is approved. <br /> <br />City. <br /> <br />PART 2. The City Manager, Larry D. Gilley, is authorized to execute the agreement on behalf of the <br /> <br />PART 3.
