<br />Section 17.05. THE LICENSEE ACKNOWLEDGES THAT IT IS FULLY APPRISED AND <br />CONSCIOUS OF, AND FULLY UNDERSTANDS, THE IMMINENT DANGERS, INCLUDING <br />SERIOUS BODILY INJURY OR DEATH FROM ELECTROCUTION, INHERENT IN <br />PERFORMING WORK ON AND NEAR THE POLES, AND ACCEPTS AS ITS DUTY AND <br />SOLE RESPONSIBILITY THE FURNISHING OF COMPETENT SUPERVISION AND <br />SUFFICIENT AND ADEQUATE TOOLS AND EQUIPMENT FOR ITS EMPLOYEES, AND <br />REQUIRING ITS AGENTS, CONTRACTORS AND SUBCONTRACTORS TO FURNISH <br />COMPETENT SUPERVISION AND SUFFICIENT AND ADEQUATE TOOLS AND <br />EQUIPMENT FOR THEIR EMPLOYEES, WITH RESPECT TO THESE DANGERS. <br /> <br />ARTICLE 18. INSURANCE <br /> <br />Section 18.01. The Licensee will maintain in full force and effect the following types of insurance <br />issued by a company authorized to do business in Texas in at least the following coverage amounts: <br /> <br />T e of covera e <br />Commercial generalliab. <br />Worker's com ensation <br />Motor vehicle liability <br /> <br />Per erson <br />$1,000,000 <br />Statutory <br />N/a <br /> <br />Per occurrence <br />$2,000,000 <br />Statutory <br />N/a <br /> <br /> <br />Or CSL/Umbrella <br />$2,000,000 <br />Statutory <br />$1,000,000 <br /> <br />Section 18.02. The specification of coverage limits In this section does not limit Licensee's <br />indemnity obligations under Article 16 in any way. <br /> <br />Section 18.03. The Licensee will maintain fire and extended coverage property insurance on the <br />Licensee's Facilities that may be placed on, within, or near City Facilities. This insurance must <br />contain a waiver of subrogation as to the City. <br /> <br />Section 18.04. The insurer on all coverages maintained by the Licensee must be authorized to do <br />business in the State of Texas and have an "A" or better rating in the most recent Best's Guide. All <br />contractors and all of their subcontractors who perform work on behalf of the Licensee will carry, in <br />full force and effect, worker's compensation, comprehensive public liability and automobile liability <br />insurance coverages of the type and amounts that the Licensee is required to obtain under this <br />Article. <br /> <br />Section 18.05. All liability coverages maintained by the Licensee and by the Licensee's contractors <br />and subcontractors must name the City as an additional insured. All of the Licensee's insurance will <br />be primary over any coverages maintained by the City. <br /> <br />Section 18.06. Prior to the execution of this Agreement, and prior to each insurance policy <br />expiration date during the term of this Agreement, the Licensee will furnish the City with a current <br />certificate of insurance and upon request, certified copies of the Licensee's insurance policies. The <br />Certificate will reference this Agreement and the worker's compensation and property insurance <br />waiver of subrogation required by this Agreement. The certificate must verify that the City will be <br />given 30 days advance notice of any cancellation or nonrenewal of coverage.
