Consider approval of Ordinance 2011 -33 amending Section 2.566 of the San Marcos <br />Citv Code to authorize the Citv Manager to approve change orders to Citv Contracts <br />involving increases or decreases of $50,000 or less: including procedural provisions; and <br />declaring an effective date. <br />MOTION: Upon a motion made by Council Member Terry and a second by Council Member <br />Thomason, MOTION TO AMEND: Upon a motion made by Council Member Terry and a <br />second by Council Member Thomason, the City Council voted (4) for and (2) opposed, Council <br />Member Porterfield and Council Member Scott, to amend the proposed Ordinance by inserting <br />City Manager, Jim Nuse in the underlined portion of Section 2.566 A. The motion carried. <br />MAIN MOTION: The City Council voted (4) for and (2) opposed, Council Member Porterfield <br />and Council Member Scott, to adopt Ordinance 2011 -33, on the first of two readings, as <br />previously captioned. The motion carried. <br />19. Consider approval of Ordinance 2011 -34, on the first of two readings, amending Section <br />86.197 of the San Marcos Citv Code authorizing a utility deposit waiver for United States <br />Active Duty Military and United States Military Veterans who meet certain criteria; <br />• including procedural provisions: and declaring an effective date. <br />MOTION: Upon a motion made by Council Member Thomason and a second by Council <br />Member Scott, MOTION TO AMEND: Upon a motion made by Council Member Porterfield <br />and a second by Council Member Thomason, the City Council voted (5) for and (1) opposed, <br />Council Member Scott, to amend the proposed Ordinance by inserting in Section 4 (a) "This <br />waiver is not applicable to Veterans or Active Duty Military personnel who transfer utility <br />service from an existing service address to new service address." The motion carried. MAIN <br />MOTION: The City Council voted (6) for and (0) opposed, to adopt Ordinance 2011 -34, on the <br />first of two readings, as previously captioned. The motion carried. <br />20. Consider approval of Ordinance 2011 -36, on the first of two readings, amendin the <br />Citv's 2010 -2011 Budget to increase funding for the installation of improvements to the <br />Police Department Firing Range from $90,000.00 to $98,800.00: and providing an effective <br />date. <br />MOTION: Upon a motion made by Council Member Thomason and a second by Council <br />Member Prather the City Council voted (6) for and (0) opposed, to approve Ordinance 2011 -36 <br />on the first of two readings, on the first of two readings, amending the City's 2010 -2011 Budget <br />to increase funding for the installation of improvements to the Police Department Firing Range <br />from $90,000.00 to $98,800.00, as previously captioned.
