<br />2. By making a lump-sum payment to the City in the amount of $1 ,000 (with any <br />amount paid to the City under Section 5.A.l above credited towards this amount) <br />no later than July 31, 2001. <br />3. By providing professional veterinary services to the City in accordance with <br />the separate agreement of the parties dated the same date as this Agreement, with <br />up to $39,000 in the value of these services to be credited against the amount of <br />the Loan. Provided, that the Guarantor may make payments to the City towards <br />this amount at any time during the term of this Agreement, and the amount of <br />such payments will be credited towards the amount of the Loan. <br />B. To dismiss the City as a party defendant from Cause No. 6112-C, pending in <br />the County Court-at-Law in Hays County, Texas, with prejudice. <br /> <br />Section 4. Agreements by the City. <br />The City agrees as follows: <br />A. To waive and release the Guarantor from payment of interest on the Loan <br />between the inception of the Loan and the date of this Agreement. <br />B. To reduce the amount payable by the Guarantor to the City by virtue of the <br />Loan by the amount of the proceeds paid by the Guarantor to the City from the sale of the <br />remaining assets of X -Squeeze Me in accordance with the separate letter agreement <br />between the City and the Guarantor dated October 26,2000. <br />C. To retain the services of the Guarantor as City Veterinarian under a separate <br />agreement bearing the same date as this Agreement, and to credit up to $39,000 of <br />amounts due to or remitted by the Vertinarian against the amount of the Loan. <br />D. To execute a full and final release of the Guarantor upon full repayment of the <br />amount of the Loan and compliance with all other terms of this Agreement. <br />E. The City assigns in full any and all rights the City has against James T. Doty <br />and Jamine K. Doty under and in accordance with the terms of the guaranties executed by <br />James T. Doty and Jamine K.
