Both projects require landowners to grant rights to the <br />city of San Marcos for sewer, road and/or drainage improvements. Pursuant to your request, please accept <br />this letter as a description of the scope of work the projects require relative to acquisition. <br /> <br />Introduction <br /> <br />COTIONWOOD CREEK SEWER PROJECT <br /> <br />The project, once constructed will provide significant city sewer service to properties within the <br />Cottonwood Creek area between the intersections of Cottonwood Creek and 135 and State Highway 123. <br />This area is under intense development pressure including potential light industrial, multi-family and <br />commercial uses. I have reviewed the project status with you, examined your land files and visited with <br />Collette Duran with the City of San Marcos (CSM) and Kyle Smith at Byrne & Associates concerning their <br />previous work on this project. Approximately fifteen (IS) separate properties have been identified as <br />within and along the proposed pipeline route. CSM has asked for assistance: determining the title <br />ownership of properties along the proposed route; updating existing title, acquiring of Right of Entry <br />permits and easement agreements from landowners granting rights to CSM for the installation and <br />maintenance of the proposed sewer pipelines. <br /> <br />As we have discussed, I have previously negotiated easements for a water line with aU but a couple of the <br />project landowners for the Hays Energy power plant a couple years ago. Landowners, it can be assumed <br />will have issues regarding routing, capacity guarantees and other sensitive matters. While this project <br />clearly offers an important improvement to the value of the properties and the potential uses the properties <br />may support, the negotiations are anticipated to be potentially complex with some landowners. <br /> <br />CWVIS BARKER ROAD IMPROVEMENT PROJECT <br /> <br />The proposed road improvement upon completion will include a widening of the subject roadway to five <br />(5) lanes. This area is currently being developed for COOllllercial and light industrial use. The roadway <br />improvement project appears to be a significant fact<X' toward providing necessary services to supp<w1 the <br />current rapid development. I have reviewed the status of this project with Mr. James Klein of your ofike. <br />
