The City Planning and Zoning Commission conducted public hearings on October lO, 2000, <br />(;f) <br />~t8ber 24,2000, November 21,2000, November 28,2000, December 12,2000 and December 19,2000 <br /><u'proposed rewrite of Article 5, PDD Planned Development Districts, of Chapter 94, Development <br />Standards, of the City Code to update and simplify City regulations for planned development districts. <br /> <br />2. The Planning and Zoning Commission voted on December 19, 2000 to recommend the <br />proposed rewrite for adoption by the City Council. <br /> <br />3. The City Council conducted a public hearing on the proposed rewrite on May 14, 2001. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. Article 5, PDD Planned Development Districts, of Chapter 94, Development <br />Standards, of the City Code is repealed in its entirety and is replaced with the following: <br /> <br />ARTICLE 5. PLANNED DEVELOPMENT DISTRICTS <br /> <br />DIVISION 1. GENERALLY <br /> <br />Section 94.216. Purpose. <br /> <br />(a) The planned development district, or PDD, is a special overlay zoning category intended for use <br />on tracts of land where special circumstances exist, and where a more flexible approach to zoning <br />is warranted. The establishment of a planned development district is intended to result in a higher <br />quality development for the community than would result from the use of conventional zoning <br />districts. <br /> <br />(b) Special circumstances warranting a PDD zoning classification include one or more of the <br />following: <br /> <br />(1) The land is located in close proximity to established residential neighborhoods where <br />conventional zoning classifications may not adequately address neighborhood concerns regarding <br />the quality or compatibility of the adjacent development, and where it may be desirable to the <br />neighborhood, the developer or the city to develop and implement mutually-agreed, enforceable <br />1 <br />
