<br />86. <br /> <br />INTERLOCAL AGREEMENT <br />WITH THE SAN MARCOS CONSOLIDATED INDEPENDENT SCHOOL DISTRICT FOR <br />SCHOOL RESOURCE OFFICERS <br /> <br />STATE OF TEXAS <br /> <br />COUNTY OF HAYS <br /> <br />The City of San Marcos (the "City") and the San Marcos Consolidated Independent School <br />District ("SMCISD") enter into this Interlocal Agreement (the "Agreement") under the authority of <br />the lnterlocal Cooperation Act (the "Act"), Chapter 791 of the Texas Government Code, as amended <br />and Section 37.081 of the Texas Education Code, as amended. <br /> <br />Section 1. Term <br /> <br />The term of this Agreement will commence on the effective date and continue until it is <br />terminated in the manner described in Section 6.f) of this Agreement. <br /> <br />Section 2. School Resource Officer Services <br /> <br />The City agrees to provide four School Resource Officers ("SROs") to the SMCISD. The <br />SROs will remain under the control and supervision of the City at all times and will remain City <br />employees, entitled to the same benefits and authority, and subject to the same restrictions as other <br />city police officers. The SROs will wear the clothing and equipment prescribed by the City while <br />providing services under this Agreement. While on campus, the SROs will work under the <br />supervision of the City SRO Coordinator in cooperation with the respective SMCISD campus <br />principal, or the principal's designated agent. The primary function of each SRO will be to serve <br />as a role model and to positively interact with students. Specific duties performed by the SROs must <br />be agreed to by both the school principal and the City's SRO Coordinator. <br /> <br />Section 3. Course and Scope of Employment <br /> <br />All police officers providing services under this Agreement will be acting in the course and <br />scope of their employment by the City at all times while engaged in the performance of services <br />under this Agreement. <br /> <br />Section 4. Compensation <br /> <br />The SMCISD will pay to the City an amount equal to the annual salary and benefits of the <br />SRO whose salary and benefits is the lowest among the SROs currently assigned by the City as of <br />each payment date under this Agreement. SMCISD will make payment to the City quarterly. The <br />SMCISD will make these payments out of current revenues available to the SMCISD. The initial <br />payment for 2001 shall be made no later than September 18, 2001. If this Agreement is terminated <br /> <br />1 <br />
