<br />7. No Reimbursement. No party shall be reimbursed by any other party for any costs <br />incurred pursuant to this agreement. <br /> <br />8. Equipment and Personnel Used by Lockhart. All equipment used by the Lockhart <br />Fire Department in carrying out this Agreement will, at the time of action hereunder, be <br />owned by it, and all personnel acting for the Lockhart Fire Department under this <br />Agreement will, at the time of such action, be an employee or reserve member of the <br />Lockhart Fire Department and acting in the scope of that employment. <br /> <br />9. Equipment and Personnel Used by San Marcos All equipment used by the San <br />Marcos Fire Department in carrying out this Agreement will, at the time of action <br />hereunder, be owned by it, and all personnel acting for the San Marcos Fire <br />Department under this Agreement will, at the time of such action, be an employee or <br />volunteer member of the San Marcos Fire Department and acting in the scope of that <br />employment. <br /> <br />10. Threat to Health and Safety. Neither party is bound by the Agreement if, at the <br />time any request for mutual-aid is made by the other party, the Fire Chief or designated <br />representative for the requested service determines in his/her sole discretion, that the <br />release of equipment and/or personnel to the requesting party, would pose a potential <br />threat to the Health and Safety of the City whose services are being requested. <br /> <br />11. Termination.
