<br /> <br /> <br /> <br />109. <br /> <br />ORDINANCE NO. 2001 - 51 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS APPROVING THE ABANDONMENT OF A PORTION OF THE RIGHT- <br />OF- WAY OF HOLLAND STREET NEAR ITS INTERSECTION WITH L.B.J. <br />DRIVE; APPROVING THE CONVEYANCE OF THIS RIGHT-OF-WAY TO <br />DANIEL C. ANDERSON AND MARGARET A. JORDAN; AUTHORIZING THE <br />CITY MANAGER TO EXECUTE A DEED; AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />RECITALS: <br /> <br />1. On July 9, 2001 , the City Council conducted a public hearing on the <br />proposed abandonment of the portion ofthe right-of-way of Holland Street depicted on the attached <br />Exhibit A (the "City Tract") near its intersection with L.B.J. Drive. <br /> <br />2. The abutting property owners, Daniel C. Anderson and Margaret A. Jordan, have approved <br />of this abandonment, and have agreed to exchange a tract of property they own, depicted on the <br />attached Exhibit B (the "Anderson Tract"), for the City Tract. <br /> <br />3. The City has had an appraisal performed of the two tracts of property to be exchanged, <br />and the appraisal shows that the two tracts of property are substantially equivalent in value. <br /> <br />4. The City Council finds and determines in accordance with Lac. GOy'T CODE <br />S272.001(b)(3) that the City Tract was originally acquired for street right-of-way, and is to be <br />exchanged for the Anderson Tract, which will be used as street right-of-way. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The abandonment of the City Tract is approved. <br /> <br />SECTION 2. The City Manager, Larry D. Gilley, is authorized to execute the Special <br />Warranty Deed attached to this ordinance conveying to Daniel C. Anderson and Margaret A. Jordan <br />the City Tract, in exchange for the Anderson Tract. <br /> <br />SECTION 3. This Ordinance will take effect 10 days after the date of its final passage, and <br />the City Secretary will publish notice of its adoption in a newspaper of general circulation in the <br />City. <br /> <br />PASSED AND APPROVED on first reading July 9, 2001. <br /> <br />PASSED AND APPROVED on second reading July 16, 2001. <br /> <br />PASSED, APPROVED AND ADOPTED <br /> <br />JU?),~o;;~' <br /> <br />David Chiu <br />Mayor <br />
