<br /> <br /> <br />122. <br /> <br />ORDINANCE 2001 - 54 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS AMENDING THE TRAFFIC <br />REGISTER MAINTAINED UNDER SECTION 82.067 OF THE <br />SAN MARCOS CITY CODE BY THE ADDITION OF A <br />CONSTRUCTION SPEED LIMIT ON IH 35 FROM THE <br />NORTHERN BOUNDARY OF THE SAN MARCOS CITY <br />LIMITS TO LOOP 82; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. Pursuant to Sections 82.003 and 82.066 of the San Marcos Code of <br />Ordinances, on the basis of an engineering and traffic investigation, and on the request of <br />TXDOT, the traffic register maintained under Section 82.067 of the San Marcos Code of <br />Ordinances is amended by adding the following speed limit: <br /> <br />IH 35 from the northern boundary of the San Marcos City Limits to Loop 82 - <br />construction speed limit of 55 m.p.h. <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance <br />is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br />provisions of this ordinance will continue in force if they can be given effect without the <br />invalid portion. <br /> <br />SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions <br />in conflict with this ordinance are repealed. <br /> <br />SECTION 4. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code. <br /> <br />SECTION 5. This ordinance shall be in effect ten (10) days from and after its <br />passage, and the City Secretary will publish notice of its adoption in a newspaper of <br />general circulation in the City. <br /> <br />PASSED AND APPROVED on first reading June 25, 2001. <br /> <br />PASSED AND APPROVED on second reading July 9, 2001. <br /> <br />PASSED, APPROVED AND ADOPTED July 23, 2001. <br />
