145. ORDINANCE 2001- 57 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 33.582 ACRE TRACT OF PROPERTY LOCATED IN THE 2400 BLOCK OF IH 35 NORTH FROM "R-1" SINGLE-FAMILY DWELLING DISTRICT (LOW DENSITY) AND "PD" PRE- DEVELOPMENT DISTRICT TO "C" COMMERCIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. RECITALS: 1. On June 12, 2001, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "R-1" Single-Family Dwelling District (Low Density) and "PD" Pre-Development District to "C" Commercial District for a 33.582 acre tract of property located in the 2400 Block ofIH 35 North. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on June 12, 2001 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the 13th day of August 2001, regarding the request. 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned "R-1" Single-Family Dwelling District (Low Density) and "PD" Pre-Development District to "C" Commercial District: Street address: 2400 Block of IH 35 North. Size: 33.582 acres. Legal description: See the metes and bounds description attached as Exhibit A.
