All costs associated with compliance with this article, including purchase, installation, testing, maintenance, repair and replacement are to be borne by the customer. Advisory assistance may be requested from the water and wastewater department and building inspection divisions without charge. Sec. 86.605. Penalty; disconnection. (a) A person who knowingly or intentionally violates, or causes or permits the violation of, any provision of this article commits a misdemeanor, and is subject to the penalty provided in Section l.O l5 of this Code upon conviction. Each day of an ongoing violation will be deemed to be a separate violation. (b) Failure, refusal or inability on the part of a customer or user to comply with any provision of this article will constitute grounds for refusing or discontinuing water service. SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in full force if they can be given effect without the invalid portion. SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 4. Any person violating any provision of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.0l5 of the San Marcos City Code upon conviction. SECTION 5. This Ordinance will take effect lO days after the date of its final passage, and the City Clerk will publish notice of its adoption in a newspaper of general circulation in the City.
