• ORDINANCE NO. 2011 - 33 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING SECTION 2.566 OF THE SAN <br />MARCOS CITY CODE TO AUTHORIZE THE CITY MANAGER TO <br />APPROVE CHANGE ORDERS TO CITY CONTRACTS <br />INVOLVING INCREASES OR DECREASES OF $50,000 OR LESS; <br />INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN <br />EFFECTIVE DATE. <br />RECITALS: <br />1. Chapter 252 of the Texas Local Government Code governs the purchasing and <br />contracting authority of municipalities. <br />2. Section 252.048 of the Texas Local Government Code, as amended by the <br />adoption of H.B. 679 in the 82 Regular Session of the Texas Legislature, <br />increased the administrative approval limit for change orders from $25,000 to <br />$50,000. <br />3. The City Council deems it appropriate to increase the city manager's <br />authority to approve change orders to $50,000 as provided by state law. <br />• BE IT ORDAINED BY THE ITY COUNCIL F THE <br />C C U O CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. Chapter 2, Section 2.566 of the San Marcos City Code is amended as <br />follows (underlining indicates added text, stf:ilethr-augh indicates deleted text): <br />Sec. 2.566. Authority of city manager -- Contracts for expenditures; limitation. <br />(a) The city manager is authorized to contract on behalf of the city for the <br />purchase of goods and services without further city council approval for all budgeted <br />items not exceeding $50,000.00. Citv manager Jim Nuse and his desianee(s) are herebv <br />authorized to approve change orders to city_ contracts involvinL- increases or decreases of <br />$50,000 or less. <br />(b) The city manager is authorized to promulgate purchasing policies and <br />procedures for all purchases made by the city. The city manager may amend these <br />policies from time to time. All these policies shall conform to applicable requirements of <br />the Charter, city ordinances and state laws and are subject to review and approval by the <br />City attorney. <br />• (c) The city manager or designee is authorized to determine the purchase method <br />for goods and services that provides the best value to the City in accordance with state <br />law. <br />(d) The city manager is authorized to approve change orders in amounts not to <br />
