71 CONTRACT TO THE CITY OF SAN MARCOS - QT- 2901/3 <br />Unless otherwise specified, pricing and Payment Terms of this Agreement are provided in U.S. dollars. <br />2o.Force Majeure <br />Neither parry will be liable hereunder by reason of any failure or delay in the performance of its obligations <br />hereunder on account of strikes, shortages, riots, insurrection, fires, flood, storm, explosions, acts of God, war, <br />governmental action, labor conditions, earthquakes, material shortages or any other cause which is beyond the <br />reasonable non - financial control of such party. <br />21. Certified JustWare Administrator <br />a) Customer will retain one or more certified JustWare Application Administrator(s) ( "Software <br />Administrator ") on staff that is responsible for the regular maintenance and configuration of the <br />JustWare Application Software (the "Software"). The Customer will provide New Dawn with the name <br />and contact information for any Software Administrator. If turnover occurs for Customer's designated <br />Software Administrator(s), Customer will notify and arrange with New Dawn for certification and <br />re- training within thirty (30) calendar days. New Dawn must schedule Software Administrator <br />training and certification testing within sixty (6o) calendar days of notice. Requests for support may <br />only be made by Certified JustWare Administrators and the San Marcos Municipal Court <br />Administrator. Support requests made by others are subject to support fee increases. Software <br />Administrator(s) will be knowledgeable regarding the current Customer production version of the <br />Software as well as the latest released version. <br />22.
