FIRST AMENDMENT OF FUNDING AGREEMENT This First Amendment of Funding Agreement ( "Amendment ") amends the Funding Agreement ( "Agreement ") made and entered into on May 18, 2010 between the City of San Marcos (the "City "), 630 East Hopkins, San Marcos, Texas, and the Lyndon Baines Johnson Museum of San Marcos, a non - profit corporation, whose mailing address is P.O. Box 3, San Marcos, Texas 78667 (the "Museum "). City and Museum may be referred to collectively, as the "Parties ". For and in consideration of the mutual promises and obligations of the Parties in this Amendment, the City and Museum agree as follows: 1. Article I - Purpose, of the Agreement is hereby amended to allow the use of the Funds provided by the City for the design and construction of an elevator in addition to the artifacts storage room and curation room as set forth in Exhibit A of the Agreement. 2. All other terms and conditions of the Agreement shall remain in effect and shall be binding on the Parties. EXECUTED in duplicate originals this 3rd day of August , 2011.
