ORDINANCE 2001- 59 184. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING LOTS 17 AND 18 OF BLOCK 3 OF THE WESTOVER ADDITION LOCATED IN THE 1300 BLOCK OF FRANKLIN STREET FROM "C" COMMERCIAL DISTRICT TO "R-l" SINGLE-FAMILY DWELLING DISTRICT (LOW DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. RECITALS: 1. On July 10, 2001, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "C" Commercial District to "R-l" Single-Family Dwelling District (Low Density) for Lots 17 and 18 of Block 3 of the Westover Addition, located in the 1300 Block of Franklin Street. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on July 10,2001 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the ---2-f...t.h- day of Auguct 2001, regarding the request. 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned "e" Commercial District to "R-l" Single-Family Dwelling District (Low Density): Street address: 1300 Block of Franklin Street. Legal description: Lots 17 and 18, Block 3 of the Westover Addition. Deed or plat reference: Volume 59, page 84, Hays County Deed Records.
