<br />D. The placement, construction or maintenance of roads, parking areas, or driveways, <br />regardless of method or materials of construction. <br /> <br />E. The placement, construction or maintenance of sidewalks, walkways, or trails consisting <br />of any form of impervious paved surface, such as concrete, asphalt, or paver stones. <br />Walkways or trails consisting of pervious surfaces such as decomposed granite are permitted. <br />The continued maintenance of an unpaved driveway to provide vehicle access for private <br />recreational use of the tract of property to the Northwest of the Property is permitted. <br /> <br />F. Vegetation. Any cutting, pruning or trimming of trees or vegetation, except for 1) the <br />removal of understory vegetation, and 2) the removal of dead or decayed trees or portions <br />of trees that pose a direct threat to human life or property. All planting or seeding of trees, <br />grass or vegetation in the Easement Area is restricted to species recognized as native to this <br />area by the Texas Agricultural Extension Service, or its successor agencies. <br /> <br />G. Surface Alteration. Any filling, grading, excavating or other alteration of the surface of <br />the Easement Area. <br /> <br />H. Dumping. Dumping or depositing garbage, trash, or other waste materials, or failing to <br />remove and properly dispose of any such waste materials, regardless of source. <br /> <br />1. The operation of motorized vehicles, such as, but not limited to, trucks, automobiles, all- <br />terrain vehicles, and motorcycles, except for use of the driveway under E. above to provide <br />vehicle access for private recreational use of the tract of property to the Northwest of the <br />Property. <br /> <br />1. The placement, construction or maintenance of signs, except that up to two signs not <br />exceeding eight square feet each may be displayed to warn against unauthorized entry or use <br />of the Easement Area, and one sign not exceeding eight square feet may be used to identify <br />the Owner and address for the Property. <br /> <br />K. Bank Improvements and Mooring. Any form of dock or pier along the river bank, or any <br />form of flotation or diving barge moored to the river bank. The construction and maintenance <br />of one improved entry point from the Easement Area to the river is permitted. Erosion <br />control along the river bank is permitted if it consists solely of the planting and maintenance <br />of native littoral vegetation. <br /> <br />L. Any use of chemical or non-organic pesticides or herbicides. <br /> <br />3. Retained Rights; Covenant and Restriction Running with the Property. <br /> <br />A. The Owner retains the right to use and enjoy the Property and Easement Area in all ways <br />that are not expressly restricted or prohibited by this Easement. In particular, the Owner <br />retains the right to sell, mortgage, bequeath, or donate the Property. <br /> <br />B. This Easement shall constitute a covenant and restriction running with the title to the <br /> <br />C:\TEMP\conservation easement.doc <br /> <br />2 <br />
