<br />207. <br /> <br />RESOLUTION NO. 2001 - 149 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING A LICENSE AGREEMENT <br />BETWEEN THE CITY AND ANN MARY CARNEY AND ROBERT <br />WHYBURN FOR THE USE OF AN UNOPENED CITY RIGHT-OF- <br />WAY ADJACENT TO THE 200 BLOCK OF RIVERSIDE DRIVE FOR <br />DRIVEWAY AND PARKING PURPOSES; AUTHORIZING THE CITY <br />MANAGER TO EXECUTE THE AGREEMENT; AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. Ann Mary Carney and Robert Whyburn are the owners of the river front lot located at 224 <br />Riverside Drive, and the only public street access for this lot is across an unopened City right-of-way <br />adjacent to the 200 block of Riverside Drive. <br /> <br />2. Ms. Carney and Mr. Whyburn have requested that the City Council approve the attached <br />License Agreement in order to allow them to construct and maintain a driveway and parking area <br />on the unopened City right-of-way. <br /> <br />3. The Planning and Zoning Commission and Zoning Board of Adjustments have both <br />recommended that this use of the unopened right-of-way be approved in connection with the <br />construction of a cabin on the property. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The attached License Agreement between the City and Ann Mary Carney and Robert <br />Whyburn is approved. <br /> <br />PART 2. The City Manager, Larry D. Gilley, is authorized to execute the License Agreement <br />on behalf of the City. <br /> <br />PART 3. <br /> <br />That this Resolution shall be in full force and effect from and after its passage. <br /> <br />ADOPTED on August 27, 2001. <br /> <br />?
