<br />requirements be applicable to other pipelines and facilities similarly situated. Grantee <br />shall comply with all City ordinances of general application. The consent and permit <br />herein granted extends to the enlargement of the diameter of any portion of the Pipeline <br />System to the extent of doubling the carrying capacity of the system as it exists on the <br />effective date of this ordinance, but it does not extend to or include any greater enlarging <br />of the diameter of the Pipeline System, nor does it extend to or include any extension of <br />the Pipeline System. <br /> <br />Section 4. Enlargement or Extension of Pipeline System. <br /> <br />(a) General. Should Grantee, during the Term of this Ordinance, desire to enlarge the <br />diameter of any portion of the Pipeline System beyond the enlargement permitted in <br />Section 3 above, or add additional pipelines to the Pipeline System, or extend the Pipeline <br />System, within any City Rights-of-Way or within other City property, the Grantee shall <br />submit a written request to, and obtain the written consent of, the City as an amendment <br />to this ordinance. The City agrees to promptly consider any such request, and render a <br />decision on the request within 90 days. The terms and conditions of any such amendment, <br />including provisions for the payment of compensation to the Grantor, will be subject to <br />negotiation by the parties, and will be similar to the terms and conditions of other consents <br />and permits granted by the City to persons or entities that are similarly situated to, or that <br />compete with, the Grantee. The City may in any given case refuse to grant its consent. <br />If the City approves such an amendment, then, after completion of construction and <br />compliance with then-existing laws and regulations of the City and other governmental <br />entities, the enlarged or expanded pipeline facilities shall become a part of the Pipeline <br />System as defined herein and covered by this Ordinance. <br /> <br />(b) Effect of Annexations and Right-of-Way Widening by City. If the City annexes an <br />area that includes new City Rights-of-Way, or if the City widens any City Rights-of-Way, <br />the permit and consent granted by the City in Section 1 shall automatically extend to and <br />include any portions of the Pipeline System within the annexed or widened area as of the <br />effective date of the annexation or widening. In the event an annexation or widening <br />causes a cumulative increase of more than 300 linear feet of EI Paso Energy's Pipeline <br />System along or under City Rights-of-Way, then the Grantee shall make an additional lump <br />sum payment to the City equal to 15 cents per linear foot of the new pipeline within City <br />Rights-of-Way, multiplied by the number of years remaining on the Term, reduced to <br />present value using a 6% discount rate. <br /> <br />Section 5. Substances. <br /> <br />Subject to the terms and conditions of this Ordinance: (a) the following substances may <br />be transported andlor delivered for purposes of sale, sale for resale, transportation or <br />purchase in any part of the Pipeline System by Grantee: natural gas or natural gas liquids, <br />in gaseous or liquid state or the equivalent thereof, whether natural or synthetic (the <br /> <br />-3- <br />
