11. THE STATE OF TEXAS COUNTY OF HAYS SUBRECIPIENT AGREEMENT COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM This Agreement, is made and entered into on this_ _ day of 20_, between the City of San Marcos (the "City"), 630 East Hopkins, San Marcos, Texas, and (the "Subrecipient"). WITNESSETH THAT: WHEREAS, the Subrecipient desires to carry out eligible activities as described in the attached Statement of Work (the "Project"), attached to and incorporated into this Agreement as Exhibit "A", pursuant to the U.S. Department of Housing and Urban Development ("HUD") Community Development Block Grant ("CDBG") Program Entitlement Grant Regulations as stipulated in CFR 570 (the "Program"); WHEREAS, City has been awarded grant funds which may be spent by the City for the provision of certain services authorized under the CDBG Program and is interested in assisting the Subrecipient in providing the community of San Marcos with those services; WHEREAS, the form ofthis Agreement was approved by the City Council of the City of San Marcos on the 17th day of September ,20---.01 Now therefore, the City and Subrecipient agree as follows: ARTICLE 1 SUBRECIPIENT'S RESPONSIBILITIES 1.1 Subrecipient acknowledges that funds granted to the Subrecipient by the City under this Agreement have been granted to the City pursuant to HUD's CDBG Program. 1.2 The Subrecipient certifies that it is authorized to receive CDBG Program funds under 24 C.F.R. Section 570. 1.3 The Subrecipient agrees to cooperate fully with the City in respect to the implementation of the CDBG Program activities to be carried out by the Subrecipient as per 24 CFR 570 and other rules, regulations and decisions as may be made by the HUD or any other federal or state agency that may legally exercise its jurisdiction over expenditures of CDBG funds. 1
