21. RESOLUTION NO. 2001- 162 R -,---- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING A CONTRACT BETWEEN THE CITY AND THE SAN MARCOS HISPANIC CHAMBER OF COMMERCE FOR THE PROVISION OF TOURISM PROMOTIONAL SERVICES DURING THE CITY'S 2001-2002 FISCAL YEAR; AUTHORIZING THE CITY MANAGER TO EXECUTE THIS CONTRACT; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. The State Legislature has authorized Texas cities to collect an occupancy tax on hotel and motel rooms and has approved certain expenditures from the proceeds of this occupancy tax in Chapter 351, Texas Tax Code. 2. The City Council of the City of San Marcos has levied a hotel occupancy tax in Article 5 of Chapter 78 of the San Marcos City Code. 3. The City Council wishes to contract with the San Marcos Hispanic Chamber of Commerce for the administration of a portion of the funds collected from the hotel occupancy tax for the purpose of providing tourism promotional services during the City's 2001-2002 fiscal year. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The budget of the San Marcos Hispanic Chamber of Commerce for the 2001-2002 fiscal year, a copy of which is attached to the contract approved in Part 2 below, is approved. PART 2. The terms and conditions of the attached Contract for Tourism Promotional Services between the City of San Marcos, Texas and the San Marcos Hispanic Chamber of Commerce for the administration of funds collected under Article 5 of Chapter 78 of the City Code and Chapter 351, Texas Tax Code, are approved. PART 3. The City Manager, Larry D. Gilley, is authorized to execute this contract on behalf of the City of San Marcos. PART 4. This Resolution is in full force and effect from and after its passage.
