ORDINANCE NO. 2001 - 72 48. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING THE ABANDONMENT OF THE ALLEYWAY BETWEEN THE 1400 BLOCKS OF HAMILTON AVENUE AND GIRARD STREET; APPROVING THE CONVEYANCE OF THIS ALLEYWAY TO HAL AND IRIS BLYTHE, JOE CALLAN, WENDELL H. AND LAURA HETHCOCK, MYRA McALLISTER, AND RICHARD AND LESLIE SALAS; AUTHORIZING THE CITY MANAGER TO EXECUTE QUITCLAIM DEEDS; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. On May 22, 2001, the City Planning and Zoning Commission conducted a public hearing on the proposed abandonment of the alleyway between the 1400 blocks of Hamilton Avenue and Girard Street, adjacent to Lots 117 through 122, and Lots 145 through 150A, of the Z. Williamson Third Addition, and voted unanimously to approve the proposal. 2. The City Council conducted a public hearing regarding this abandonment on September 10, , 2001. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The abandonment of the alleyway between the 1400 blocks of Hamilton Avenue and Girard Street, adjacent to Lots117 through Lot 122, and Lots 145 through 150A of the Z. Williamson Third Addition is approved. SECTION 2. The City Manager, Larry D. Gilley, is authorized to execute quitclaim Deeds conveying to Hal Blythe, Joe Callan, Wendell and Laura Hethcock, Myra McAllister and Richard and Leslie Salas their pro--rata shares of the alleyway, without cash consideration. SECTION 3. This Ordinance will take effect 10 days after the date of its final passage, and the City Secretary will publish notice of its adoption in a newspaper of general circulation in the City. PASSED AND APPROVED on first reading September 10, 2001. PASSED AND APPROVED on second reading September 17, 2001 PASSED, APPROVED AND ADOPTED October 8, 2001.
