ORDINANCE NO. 2001- 53. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 68.41 ACRES, MORE OR LESS, LOCATED ADJACENT TO THE 1700 BLOCK OF RANCH ROAD 12 (MAJESTIC ESTATES TRACT); APPROVING A SERVICE PLAN FOR THIS TRACT; INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. The City Council of the City of San Marcos, Texas, provided an opportunity for all interested persons to be heard at two public hearings, held on Augus t 13. 2001 , and on Augus t 20, 2001 , to consider the proposed annexation by the City of a 68.41 acre, more or less, tract ofland consisting of the 67.41 acre tract described on the attached Exhibit A-I and the 1.00 acre, more or less, tract described on the attached Exhibit A-2 (these tracts being collectively referred to as the "Annexation Area"), located in the 1700 block of Ranch Road 12, in Hays County, Texas. 2. The City has received the petition for annexation from the owner(s) of the property included in the Annexation Area, a copy of which is attached to this ordinance as Exhibit B. 3. An on-site public hearing has not been requested in writing by more than 10% of the adults who are permanent residents of the Annexation Area. 4. A notice of each of the public hearings was published in the San Marcos Daily Record, a newspaper having general circulation in the City and in the Annexation Area, on August 2.2001 and AlIElIst 11,7001 , these dates being on or after the 20th day and before the 10th day before the date of the respective hearings. A notice of each of the public hearings was also posted on the City's Internet website on or after the 20th day and before the 10th day before the date of the respective hearings, and these notices remained posted on the web site until the dates of the respective hearings. 5. Prior to the publication of the notices of the public hearings, the City Council directed preparation of a service plan that provided for the extension of municipal services to the Annexation Area. 6. The proposed service plan was made available for inspection and explained to the residents, if any, of the Annexation Area at the public hearings. 7. The Annexation Area is contiguous and adjacent to the current boundaries of the City. 8. Notice of all meetings of, and all deliberations of, the City Council involving the annexation of the Annexation Area, including public hearings and the vote(s) on adoption of this C:\TEMP\annex ord-Majestic Estates.doc
