58. ORDINANCE NO. 2001- 75 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 249.96 ACRES, MORE OR LESS, LOCATED ADJACENT TO THE 3000-3900 BLOCKS OF IH-35 SOUTH (McCARTY-CENTERPOINT TRACT); APPROVING A SERVICE PLAN FOR THIS TRACT; INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EFFECTIVE DATE. RECIT ALS: 1. The City Council of the City of San Marcos, Texas, provided an opportunity for all interested persons to be heard at two public hearings, held on August 11, 2001 , and on August 20, 2001 , to consider the proposed annexation by the City of a 249.96 acre, more or less, tract of land described on the attached Exhibit A (the "Annexation Area"), located in the 3000-3900 blocks ofIH-35 South, in Hays County, Texas. 2. An on-site public hearing has not been requested in writing by more than 10% of the adults who are permanent residents of the Annexation Area. 3. A notice of each of the public hearings was published in the San Marcos Daily Record, a newspaper having general circulation in the City and in the Annexation Area, on Augus t 2, 2001 and Augus t 8, 2001 , these dates being on or after the 20th day and before the 10th day before the date of the respective hearings. A notice of each of the public hearings was also posted on the City's Internet website on or after the 20th day and before the 10th day before the date of the respective hearings, and these notices remained posted on the web site until the dates of the respective hearings. 4. Prior to the publication of the notices of the public hearings, the City Council directed preparation of a service plan that provided for the extension of municipal services to the Annexation Area. 5. The proposed service plan was made available for inspection and explained to the residents, if any, of the Annexation Area at the public hearings. 6. The Annexation Area is contiguous and adjacent to the current boundaries of the City on at least two sides. 7. Notice of all meetings of, and all deliberations of, the City Council involving the annexation of the Annexation Area, including public hearings and the vote( s) on adoption of this ordinance, were done and performed in accordance with the Texas Open Meetings Law, TEX.
