ORDINANCE NO. 2011- 3 7 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING THE OFFICIAL ZONING MAP OF THE <br />CITY BY REZONING 433 ACRES, MORE OR LESS, OF LAND OUT OF <br />THE WILLIAM WARD SURVEY NO. 3, THE J.W. WILLIAMS SURVEY <br />NO. 11 AND A PORTION OF THE BLANCO VISTA SUBDIVISION <br />LOCATED AT BLANCO VISTA BOULEVARD AND TRAIL RIDGE <br />PASS FROM "MU" MIXED USE DISTRICT TO "PDD" PLANNED <br />DEVELOPMENT DISTRICT WITH BASE ZONING OF "MU" MIXED <br />USE DISTRICT; APPROVING PLANNED DEVELOPMENT DISTRICT <br />STANDARDS FOR THE BLANCO VISTA SUBDIVISION PDD; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br />RECITALS: <br />1. On July 12, 2011, the City Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning for 433 acres, more or <br />less, of land out of the William Ward Survey No. 3, the J.W. Williams Survey No. 11 and a <br />portion of the Blanco Vista Subdivision located at Blanco Vista Boulevard and Trail Ridge Pass, <br />as described in the attached Exhibits "A -1" and "A -2" (the "Project Site "), from "MU" Mixed <br />Use District to "PDD" Planned Development District with base zoning of "MU" Mixed Use. <br />2. Subsequent to the public hearing on such date, the Planning and Zoning <br />Commission, on July 26, 2011, considered and voted to approve the request, and has <br />recommended that the request be approved by the City Council of the City of San Marcos. <br />3. The City Council held a public hearing on August 2, 2011, regarding the request. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Zoning Map amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Official Zoning Map of the City, as described in Section 4.1.2.2 of the <br />City Land Development Code, is amended to rezone the following tract of land comprising the <br />Project Site, from "MU" Mixed Use District to "PDD" Planned Development District with base <br />zoning of "MU" Mixed Use, subject to the provisions of the Plarined Development District <br />Standards described in Section 2 of this Ordinance: <br />Street address: Blanco Vista Boulevard and Trail Ridge Pass <br />
