<br />(h) Signatories to applications. l...pplications must be signed as follows: <br /> <br />(1) For a corporation, a principal executive officer (president, vice president, or a duly <br />authorized representati'.'e) must sign the application. The planning director may require a <br />representative to submit "witten proof ofthe authorization. <br /> <br />(2) For a partnership, a general partner must sign the application. <br /> <br />(3) For a political entity such as a municipality, state, federal or other public agency, <br />either a principal executive officer or a duly authorized representative must sign the application. <br />The planning director may require a representative to submit vlritten proof of the authorization. <br /> <br />(1) For an individual or sole proprietorship, the individual or sole proprietor must sign <br />the application. <br /> <br />(i) The applicant must submit to the planning director a copy of all certifications related to the <br />project submitted by the applicant to the TNRCC undcr thc Tl'JRCC Ed'.vards Aquifer Rules. <br /> <br />Sec. 94.514 Petition for relief Proccssing of subdivision construction plans and <br />development plat applications. <br /> <br />lilLRight to oetition. An owner of land or applicant for development who is aggrieved by <br />application of the standards of this article may petition for relief to the city council. The <br />petition must be submitted within ten days of any final decision rendered by the planning <br />director or the commission on the aquifer protection plan. The petition must include or be <br />accompanied by all of the following: <br /> <br />(1 ) The development application. <br /> <br />(2) The aquifer protection plan submitted by the petitioner. <br /> <br />(3) A coPy of the j)lanning director's report on the plan. <br /> <br />( 4) The final decision rendered on the aquifer protection plan by the planning director or <br />the commission. <br /> <br />(5) A statement of the grounds for the petitIOn. This statement must include an <br />allegation that the application of the standards of this article deprives the petitioner of a vested <br />property right or of all economically viable use of the petitioner's land, or, in the case of land <br />located in the city's extraterritorial iurisdiction, has resulted in devaluation in the fair market <br />value of the land by at least 25%. <br /> <br />(6) An unconditional waiver of any claim that the development application has not been <br />processed in accordance with any time limits otherwise established by law. <br /> <br />C:\TEMP\Edwards Regulations revision tinal.doc <br /> <br />25 <br />
