<br />(a) The holder of the approved aquifer protection j)lan is responsible for compliance with this <br />article and the terms and conditions of the approved plan, including the construction, operation <br />and maintenance of all temporary BMPs and permanent BMPs shown on the approved plan or <br />described in the accompanying technical report, through all phases of implementation. The <br />holder is responsible for notifying all persons engaged in development activities on the site of <br />the requirements of this article and the terms and conditions of the approved plan, including the <br />construction, operation and maintenance of all temporary BMPs and permanent BMPs shown <br />on the approved plan or described in the accompanying technical report. Any failure to comply <br />with any provision of this article or any term or condition of the approval by any person <br />engaged in work on a development on the site will constitute a violation of this section by the <br />holder and will subiect the holder to enforcement under section 94.518. <br /> <br />(b) Any person engaged in work on a development who violates any provision of this article or <br />any term or condition of the aj)Proval of the aquifer protection plan for the development, <br />including the construction, operation and maintenance of all temporary BMPs and permanent <br />BMPs shown on the approved plan or described in the accompanying technical report, violates <br />this section and is subiect to enforcement under section 94.518. <br /> <br />(a) Vlhen a regulated activity conducted in the transition zone includes any excavation, the <br />person performing the regulated activity must either engage a qualified geologist to inspect the <br />excayation upon completion, or notify the planning director to arrange for inspection of the <br />excavation by city personnel upon completion. The inspection will be for the purpose of <br />determining whether the excavation has uncovered any geologic or mUll:ffiade feature that <br />presents a possible avenue for recharge to the aquifer. If the inspection reveals that one or more <br />such features has been uncovered, the person performing the regulated uctivity must: <br /> <br />(1) immediately notify the plunning director; <br /> <br />(2) utilize temporary BMPs to prevent pollution from entering the aquifer through the <br />features; and <br /> <br />(3) not perform any further work in the excavation until an application for review of the <br />development is submitted to and approved by the planning director. <br /> <br />(b) .^,n application for review under this section must include, at a minimum, the following <br />information: <br /> <br />(1) Name, address, and telephone number of the property owner and the applicant. <br /> <br />(2) .^' brief description of the development for which the application is submitted. <br /> <br />(3) .^~ scale drmving depicting the boundaries of the site, the location of the development <br />on the site, the location of the relevant exca'Iation, and the drainage patterns on the site in the <br />vicinity of the excavation. <br /> <br />C:\TEMP\Edwards Regulations revision final.doc <br /> <br />34 <br />
