<br />ill t The TNRCC Edwards Aquifer rules~ <br /> <br />(3) V.T.C.A Water Code, Chapter 26, as amended; and <br /> <br />(4) V.T.C.A. Local Government Code, Section 401.002, as amended. <br /> <br />\Vith respect to the requirements for development plats contained in this article, the <br />requirements are adopted under authority of V.T.C.l~. Local Government Code Chapter 212, <br />Subchapter B, as amended. <br /> <br />(b) Where a provision of this article conflicts with a provision of the TNRCC Edwards Aquifer <br />rules, or any other provision of this Code article 3 of this chapter (pertaining to drainage and <br />erosion control), the stricter provision, with respect to the effects imposed on a development <br />regulated activity, will govern. <br /> <br />Sec. 94.503. Definitions. <br /> <br />In this article: <br /> <br />Best management practices or BMPs means activities, prohibitions of practices, maintenance <br />procedures, and other management practices to prevent or reduce the pollution of the Edwards <br />Aquifer and hydrologically connected surface streams. BMPs also include treatment <br />requirements, operating procedures, and practices to control site runoff, spillage or leaks, sludge <br />or waste disposal, or drainage from raw material storage. BMPs are described in the TNRCC <br />BMP Guidance Manual. <br /> <br />Buffer zone means an area of land adiacent to a water quality zone for a minor waterway, <br />intermediate waterway or maior waterway, that serves a function of filtering contaminants from <br />water that drains across the area. <br /> <br />Commence construction or commencing construction means the initial disturbance of soils <br />associated with clearing, grading, or excavating activities or other construction or development <br />regulated activities. <br /> <br />Commission means the city planning and zoning commission. <br /> <br />Critical watcr quality zonc means the area along minor, intermediate or major waterways where <br />no development or disturbance of native vegetation is allovied, other than appro','cd road and <br />utility crossings. <br /> <br />Develooment means any construction-related activity, other than an exempt activity described in <br />section 94.504( c), having the potential for polluting the aquifer or surface streams that are <br />hydrologically connected to the aquifer. Development includes, but is not limited to: <br /> <br />(1) construction of buildings, utility stations, utility lines, sewage lift stations, roads, <br />highways, or railroads; or <br /> <br />C:\TEMP\Edwards Regulations revision final.doc <br /> <br />4 <br />
