<br />Sec. 94.52~ 8. Requirements for developments unregulated activities, and for regulated <br />activities not covered by an aquifer protection plan developmcnt plat or subdivision <br />construction plans. <br /> <br />(a) Temporary erosion and sedimentation controls are required to be installed and maintained <br />for the following activities that are not covered by an aquifer protection plan regulated <br />activities, if they occur in the recharge zone or in an area of the transition zone that drains <br />across the recharge zone: <br /> <br />(1) The construction or expansion remodeling of one single family home or accessory <br />structure on a legally platted lot, or on an unsubdivided tract of land at least two acres in size, <br />for which a legal description was contained in a deed recorded before March 1, 2000. <br /> <br />(2) The installation or maintenance of utility lines by a governmental entity. <br /> <br />(3) Landscaping activities involving more than 5,000 square feet of area of landscape <br />installation. <br /> <br />(4) The resurfacing of existing paved roads, parking lots, sidewalks, or other <br />development-related impervious surfaces. <br /> <br />(b) Temporary erosion and sedimentation controls are required to be installed and maintained <br />for a development regulated activities that is are not required to be covered by an aquifer <br />protection plan, development plat or subdivision construction plans if the activities occur in the <br />recharge zone or in an area of the transition zone that drains across the recharge zone. <br /> <br />(c) All temporary erosion and sedimentation controls required under this section must: <br /> <br />(1) HffiSt meet the applicable standards and requirements of the TNRCC Edwards <br />Aquifer rules and the TNRCC BMP guidance manual; <br /> <br />(2) HffiSt be installed prior to commencing construction; <br /> <br />(3) HffiSt be maintained during construction; and <br /> <br />(4) may not be removed until only when vegetation is established and the construction <br />area is stabilized. <br /> <br />(d) The engineering director will monitor stormwater discharges from these activities to <br />evaluate the adequacy of the temporary erosion and sedimentation control measures. The <br />engineering director may require the person performing the activity to use additional controls if <br />the director determines that the controls used by the person are inadequate to protect water <br />quality. <br /> <br />Sec. 94.5219.
