<br /> <br /> <br />97. <br /> <br />ORDINANCE 2001 - 78 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS AMENDING THE TRAFFIC <br />REGISTER MAINTAINED UNDER SECTION 82.067 OF THE <br />SAN MARCOS CITY CODE BY THE ADDITION OF A <br />CONSTRUCTION SPEED LIMIT ON DETOUR ROUTES <br />BETWEEN PROSPECT AND HOPKINS; INCLUDING <br />PROCEDURAL PROVISIONS; PROVIDING FOR <br />PENALTIES, AND DECLARING AN EMERGENCY. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. Pursuant to Sections 82.003 and 82.066 of the San Marcos Code of <br />Ordinances, on the basis of an engineering and traffic investigation, the traffic register <br />maintained under Section 82.067 of the San Marcos Code of Ordinances is amended by <br />adding a 20 mile per hour construction speed limit: <br /> <br />On Johnson Avenue from Hopkins Street to Belvin Street <br />On Belvin Street from Johnson Avenue to Dixon Street <br />On Quarry Street from Belvin Street to Prospect Street <br />On Prospect Street from Quarry Street to Clara Street <br />On Clara Street from Prospect Street to Belvin Street <br /> <br />SECTION 2. The engineering and traffic investigation and a map are attached as <br />exhibits. <br /> <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance <br />is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br />provisions of this ordinance will continue in force if they can be given effect without the <br />invalid portion. <br /> <br />SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions <br />in conflict with this ordinance are repealed. <br /> <br />SECTION 5. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code. <br /> <br />SECTION 6. The importance of this Ordinance creates an emergency and an <br />imperative public necessity, and the provisions of the Charter requiring that ordinances <br />be presented at three separate meetings, and that ordinances do not take effect until <br />10 days after the date of final passage are suspended, and this Ordinance will take <br />effect upon publication of notice of its adoption in a newspaper of general circulation in <br />the City. <br />
