<br />124. <br /> <br />RESOLUTION NO. 2001- 187 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING A LETTER AGREEMENT <br />BETWEEN THE CITY AND THE PEDERNALES ELECTRIC <br />COOPERATIVE, INC. REGARDING THE METHODOLOGY FOR <br />DETERMINING FRANCHISE FEE PAYMENTS; AND <br />PROVIDING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. In Ordinance 1990-52, the City Council of the City of San Marcos, Texas, granted to the <br />Pedemales Electric Cooperative, Inc. ("PEC") a non-exclusive franchise (the "Franchise") to provide <br />electric utility service in the City. <br /> <br />2. In Ordinance 2000-53, the City Council extended the Franchise, and amended the <br />Franchise effective January 1, 2002 to change the methodology for determining franchise fee <br />payments in accordance with changes in state law. <br /> <br />3. PEC, by letter to Mayor David Chiu dated October 19,2001, a copy of which is attached <br />to this Resolution (the "Request Letter"), has requested permission from the City to delay the <br />implementation of the change in methodology for determining franchise fee payments, until such <br />time as PEC begins to offer retail customer choice in its service area. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />P ART 1. The request by PEC to delay the implementation of the change in methodology for <br />determining franchise fee payments until such time as PEC begins to offer retail customer choice in <br />its service area is approved, and the Request Letter is approved. <br /> <br />P ART 2. The Mayor, David Chiu, is authorized to execute the Request Letter on behalf of <br />the City. <br /> <br />P ART 3.
