157. ORDINANCE NO. 2001- 82 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 1,253 ACRES, MORE OR LESS, INCLUDING LAND IN THE VICINITY OF THE 2400-3000 BLOCKS OF HUNTER ROAD AND THE 100- 500 BLOCKS OF McCARTY LANE, AND THE WILLOW CREEK, RIDGE AT WILLOW CREEK, RIDGE AT STONE CLIFF, LAUREL ESTATES, TURKEY HOLLOW AND QUARRY SPRINGS SUBDIVISIONS (SOUTHWEST SAN MARCOS TRACT); APPROVING A SERVICE PLAN FOR THIS TRACT; MAKING CERTAIN FINDINGS; INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. The City Council of the City of San Marcos, Texas, provided an opportunity for all interested persons to be heard at two public hearings, held on September 17, 2001, and on September 24,2001, to consider the proposed annexation by the City of a 1,253 acre, more or less, tract of land described on the attached Exhibit A (the "Annexation Area"), located in the vicinity of the 2400-3000 blocks of Hunter Road and the 100-500 blocks of McCarty Lane and the Willow Creek, Ridge at Willow Creek, Ridge at Stone Cliff, Laurel Estates, Turkey Hollow and Quarry Springs subdivisions, in Hays County, Texas. 2. A notice of each of the public hearings was published in the San Marcos Daily Record, a newspaper having general circulation in the City and in the Anncx2.tion Area, on September 6, 2001 and September 12, 2001, these dates being on or after the 20th day and before the 10th day before the date of the respective hearings. A notice of each of the public hearings was also posted on the City's Internet website on or after the 20th day and before the 10th day before the date of the respective hearings, and these notices remained posted on th,~ website until the da~es of the respective heariLgs. 3. Prior to the publication of the notices of the public hearings, the City Council directed preparation of a service plan that provided for the extension of municipal services to the Almexation Area. 4. The proposed service plan (the "Service Plan"), a copy of which is attached hereto as Exhibit B and incorporated herein for all purposes, was made available for inspection and explained to the residents of the Annexation Area at the public hearings. 5. The Annexation Area is contiguous and adjacent to the current boundaries of the City on at least two sides. 6. The City Council has received and considered evidence that the portion of the Annexation Area that is to the west of Hunter Road, outside the wastewater service extension area as shown on Map 2 attached to the Service Plan, has different characteristics of land use and population density from existing developed areas of the City. 7.
