<br />157. <br /> <br />ORDINANCE NO. 2001- 82 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ANNEXING TO THE CITY A TRACT OF LAND <br />CONTAINING 1,253 ACRES, MORE OR LESS, INCLUDING LAND IN THE <br />VICINITY OF THE 2400-3000 BLOCKS OF HUNTER ROAD AND THE 100- <br />500 BLOCKS OF McCARTY LANE, AND THE WILLOW CREEK, RIDGE <br />AT WILLOW CREEK, RIDGE AT STONE CLIFF, LAUREL ESTATES, <br />TURKEY HOLLOW AND QUARRY SPRINGS SUBDIVISIONS <br />(SOUTHWEST SAN MARCOS TRACT); APPROVING A SERVICE PLAN <br />FOR THIS TRACT; MAKING CERTAIN FINDINGS; INCLUDING <br />PROCEDURAL PROVISIONS; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City Council of the City of San Marcos, Texas, provided an opportunity for all <br />interested persons to be heard at two public hearings, held on September 17, 2001, and on <br />September 24,2001, to consider the proposed annexation by the City of a 1,253 acre, more or <br />less, tract of land described on the attached Exhibit A (the "Annexation Area"), located in the <br />vicinity of the 2400-3000 blocks of Hunter Road and the 100-500 blocks of McCarty Lane and <br />the Willow Creek, Ridge at Willow Creek, Ridge at Stone Cliff, Laurel Estates, Turkey Hollow <br />and Quarry Springs subdivisions, in Hays County, Texas. <br /> <br />2. A notice of each of the public hearings was published in the San Marcos Daily Record, <br />a newspaper having general circulation in the City and in the Anncx2.tion Area, on <br />September 6, 2001 and September 12, 2001, these dates being on or after the 20th day and before <br />the 10th day before the date of the respective hearings. A notice of each of the public hearings <br />was also posted on the City's Internet website on or after the 20th day and before the 10th day <br />before the date of the respective hearings, and these notices remained posted on th,~ website until <br />the da~es of the respective heariLgs. <br /> <br />3. Prior to the publication of the notices of the public hearings, the City Council directed <br />preparation of a service plan that provided for the extension of municipal services to the <br />Almexation Area. <br /> <br />4. The proposed service plan (the "Service Plan"), a copy of which is attached hereto as <br />Exhibit B and incorporated herein for all purposes, was made available for inspection and <br />explained to the residents of the Annexation Area at the public hearings. <br /> <br />5. The Annexation Area is contiguous and adjacent to the current boundaries of the City <br />on at least two sides. <br /> <br />6. The City Council has received and considered evidence that the portion of the <br />Annexation Area that is to the west of Hunter Road, outside the wastewater service extension <br />area as shown on Map 2 attached to the Service Plan, has different characteristics of land use and <br />population density from existing developed areas of the City. <br /> <br />7.
