ordinance, were done and performed in accordance with the Texas Open Meetings Law, TEX. GOy'T CODE ANN. Chapter 551, as amended. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The recitals of this ordinance are approved and adopted as though fully set forth in this section of this ordinance, and all exhibits attached to this ordinance, as referred to in the recitals, are incorporated herein for all purposes. SECTION 2. The City Council finds and determines that that the portion of the Annexation Area to the west of Hunter Road, outside the wastewater service extension area as shown on Map 2 attached to the Service Plan, has different characteristics of land use and population density from existing developed areas of the City that constitute a sufficient basis for providing a different level of wastewater utility service to that area. SECTION 3. The Annexation Area is annexed to the City of San Marcos, Texas. SECTION 4. The Service Plan for the Annexation Area, a copy of which is attached hereto as Exhibit B and incorporated herein for all purposes, is approved. SECTION 5. The corporate limits of the City are extended to include the Annexation Area. SECTION 6. The Annexation Area is a part of the City of San Marcos, Texas, and residents in it are entitled to all the rights and privileges of all citizens of the City, and are bound by the Charter, acts, ordinances, resolutions and regulations of the City. SECTION 7. The City Clerk will publish notice of adoption of this ordinance within 10 days of the date of its adoption. This ordinance will take effect 10 days after the date of its adoption.
