<br /> <br /> <br /> <br />192. <br /> <br />ORDINANCE NO. 2001 - 84 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING THE RELEASE OF AN ELECTRICAL <br />EASEMENT ON A 59 ACRE, MORE OR LESS, TRACT OF REAL <br />PROPERTY OWNED BY FIVE TREE, LIMITED LOCATED IN THE 1800 <br />BLOCK OF RANCH ROAD 12; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE A RELEASE OF THE EASEMENT; AND INCLUDING <br />PROCEDURAL PROVISIONS. <br /> <br />RECITALS: <br /> <br />1. Robert A. Copeland, Jr., representing Five Tree, Limited, has requested that <br />the City release an electrical line easement within a 59 acre, more or less, tract of land <br />owned by Five Tree, Limited, located in the 1800 block of Ranch Road 12 (the "Property"). <br />The easement was conveyed to the Lower Colorado River Authority and recorded in <br />Volume 257, Page 422 of the Deed Records for Hays County, Texas, and was conveyed <br />from the Lower Colorado River Authority to the City of San Marcos in a deed recorded in <br />Volume1324, Page 860 of the Official Records of Hays County, Texas. <br /> <br />2. The San Marcos Electric Utility Department staff has approved the release of <br />this easement. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The terms and conditions of the attached Release of Easement <br />related to the Property are approved. <br /> <br />SECTION 2. The City Manager, Larry D. Gilley, is authorized to execute the <br />attached Release of Easement on behalf of the City. <br /> <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance <br />is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br />provisions of this ordinance will continue in full force if they can be given effect without the <br />invalid portion. <br /> <br />SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions <br />in conflict with this ordinance are repealed. <br /> <br />SECTION 5. This Ordinance will take effect 10 days after the date of its final <br />passage, and the City Secretary will publish notice of its adoption in a newspaper of <br />general circulation in the City. <br /> <br />PASSED AND APPROVED on first reading November 15, 2001. <br />c:\ TEMP\ORDRR 12apt.doc <br />
