<br />236. <br /> <br />RESOLUTION NO. 2001- 219 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING AN EXTENSION OF THE CITY'S <br />WATER AND W ASTEW A TER SYSTEMS TO SERVE TWO TRACTS <br />OF PROPERTY OUTSIDE THE CITY, ONE AT 200 SPRING ROAD, <br />AND THE OTHER AT 1627 GORDON STREET; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. City Code Section 86.003( c) requires City Council approval for the extension of City water or <br />wastewater mains to serve uses outside the City limits. <br /> <br />2. Jay Horton, owner of a one acre tract of property at 200 Spring Road, and Roy McMullin, owner <br />of an eight acre tract of property at 1627 Gordon Street (collectively, the "Applicants"), have requested <br />permission to extend City water and wastewater mains to serve their respective properties as described on the <br />attached map (the "Properties"), which are outside the city limits. <br /> <br />3. These main extensions appear to be feasible and are to be constructed at the sole expense ofthe <br />Applicants. <br /> <br />4. The Applicant has submitted a written request for annexation of the Property by the City. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The extension of the City's water and wastewater system mains to serve the Properties, to <br />be constructed at the sole expense of the Applicants, and on the basis of the Applicants' requests for <br />annexation of the Properties, is approved. <br /> <br />PART 2. This Resolution shall be in full force and effect from and after its passage. <br /> <br />ADOPTEDon December 17, 2001. <br /> <br />~ <br /> <br /> <br />
