<br />If" <br /> <br />28. <br /> <br />ORIGINAL <br /> <br />INTERLOCAL AGREEMENT <br />BETWEEN HA YS COUNTY <br />AND THE CITY OF SAN MARCOS <br /> <br />STATE OF TEXAS <br /> <br />COUNTY OF HA YS <br /> <br />The City of San Marcos ("City") and Hays County (the "County"), enter into this <br />Interlocal Agreement under the authority of the Interlocal Cooperation Act, Chapter 791 of the <br />Texas Government Code, as amended. Both parties understand that funding for this Agreement <br />is from Homeland Security grant funds funneled through the Capital Area Planning Council to <br />the County. The vehicle to be purchased with the grant funds (the "vehicle") will be used by the <br />City's HAZMAT team in its function as a Regional Weapons of Mass Destruction Response <br />Team, as well as, in cooperation with the County for response to HAZMAT and regional <br />catastrophic events in accordance with the CAPCO InteIjurisdictional Mutual Aid Agreement <br />executed by the City and the County on April 13, 2004. <br /> <br />Section 1. Scope of Services <br /> <br />A. City Aueements: <br /> <br />The City agrees to: <br /> <br />1) Provide all maintenance, upgrades, auto liability and auto physical <br />damage coverage for the vehicle. <br />2) Name the City Fire Marshal, as the City's Project Manager. <br />3) Operate the vehicle as a Chemical-Biological-Radiological-Nuclear-Explosive <br />("CBRNE") and HAZMAT/Fire response vehicle. <br />4) In addition to the City's name, display the County's name on the vehicle. <br />5) Provide service to the County, as applicable, in accordance with the existing <br />mutual aid agreements, in the event of a catastrophic emergency. <br />6) Stock and maintain a supply of all HAZMA T operational materials necessary for <br />the continued operation of the vehicle. <br />7) Upon termination of this agreement, deliver the vehicle back to the County. <br /> <br />B. County Al!reements: <br /> <br />The County agrees to: <br /> <br />I) Provide the vehicle to the City for the City's exclusive use during the term of this <br />Agreement (a custom manufactured vehicle valued at $257,000.00 constructed by <br />American Lafrance Corporation). <br />2) To name the County Fire Marshall as the County's Project Manager. <br />1 <br /> <br />"t <br />
