ORIGINAL INTERLOCAL AGREEMENT BETWEEN HA YS COUNTY AND THE CITY OF SAN MARCOS STATE OF TEXAS COUNTY OF HA YS The City of San Marcos ("City") and Hays County (the "County"), enter into this Interlocal Agreement under the authority of the Interlocal Cooperation Act, Chapter 791 of the Texas Government Code, as amended. Both parties understand that funding for this Agreement is from Homeland Security grant funds funneled through the Capital Area Planning Council to the County. The vehicle to be purchased with the grant funds (the "vehicle") will be used by the City's HAZMAT team in its function as a Regional Weapons of Mass Destruction Response Team, as well as, in cooperation with the County for response to HAZMAT and regional catastrophic events in accordance with the CAPCO InteIjurisdictional Mutual Aid Agreement executed by the City and the County on April 13, 2004. Section 1. Scope of Services A. City Aueements: The City agrees to: 1) Provide all maintenance, upgrades, auto liability and auto physical damage coverage for the vehicle. 2) Name the City Fire Marshal, as the City's Project Manager. 3) Operate the vehicle as a Chemical-Biological-Radiological-Nuclear-Explosive ("CBRNE") and HAZMAT/Fire response vehicle. 4) In addition to the City's name, display the County's name on the vehicle. 5) Provide service to the County, as applicable, in accordance with the existing mutual aid agreements, in the event of a catastrophic emergency. 6) Stock and maintain a supply of all HAZMA T operational materials necessary for the continued operation of the vehicle. 7) Upon termination of this agreement, deliver the vehicle back to the County. B. County Al!reements: The County agrees to: I) Provide the vehicle to the City for the City's exclusive use during the term of this Agreement (a custom manufactured vehicle valued at $257,000.00 constructed by American Lafrance Corporation). 2) To name the County Fire Marshall as the County's Project Manager. 1 "t
